These Terms and Conditions ("Terms") apply to the Bitjust platform located at bitjust.co ("the Website"), Bitjust LTD ("the Company"), a company incorporated in the Republic of the Marshall Islands, and its affiliates and subsidiaries (collectively, "Bitjust", "we", "us" and/or "our(s)"), and all Bitjust products and services (jointly, "the Services"). By using the Website, you ("the User" or "You" and/or "your(s)") expressly accept all terms and conditions contained herein in full. You must not use the Website if You have any objection to any of these Terms. The User must be at least 18 years old.

1. Modifications to the Terms

We may, at any time, and at our sole discretion, modify these Terms, including our Privacy Policy, with or without notice to the User. Any such modification will be effective immediately upon public posting. Your continued use of our Services and the Website following any such modification constitutes your acceptance of these modified Terms.

2. Registration

By registering as a user on the Platform and accepting these Terms, You enter into a binding agreement ("the Agreement") with the Company. Only registered users are entitled to use the Services offered by Bitjust.

While using the Platform, You confirm that You meet the following criteria: You are an eligible individual or a legal entity with full legal capacity in your respective domicile; You are at least 18 years old; You are not the subject of any insolvency proceedings; You have full legal capacity to enter into the Agreement; You are not under the influence of alcohol, drugs, psychoactive, toxic or other intoxicating substances.

You may not register a Bitjust Account or use the Platform if You are a resident of any jurisdiction in which the Company is not authorized to provide its Services; either the European Union or the United States of America have embargoed goods or services which match the Services we offer; or your use of Services is deemed to be illegal (collectively, a "Restricted Jurisdiction").

You represent and warrant that You do not reside or are not currently located in a Restricted Jurisdiction, and will not attempt to register a Bitjust Account or use our Services by circumventing any methods we have in place to restrict access.

We may use controls or other checks to restrict access to the Platform from any Restricted Jurisdiction.

You represent and confirm that You have not been placed on any sanctions list by any governmental authority, and You will not use the Platform to conduct any illegal or illicit activity. If You use the Platform Services and conceal your residing territory or your placement on any sanctions list, we reserve the right to stop rendering Services and terminate the Agreement immediately.

3. Identity Verification

The User represents, warrants and undertakes that all information provided to Bitjust at any relevant time is true, complete, accurate, current and not misleading. The User undertakes to maintain and update all such information accordingly and to immediately inform Bitjust of any relevant changes.

The User irrevocably undertakes to provide to Bitjust, promptly upon demand, any information or documentation as Bitjust may request. The User expressly permits and authorizes Bitjust and its employees or authorized persons to provide any information and copies of any documents as may be required pursuant to any KYC process.

The User shall comply with such identification, customer due diligence, and anti-money laundering requirements that Bitjust may require from time to time.

4. Nature of Services

Bitjust provides digital asset management, cryptocurrency wealth management, and related financial services. The Services do not constitute financial advice, investment advice, tax advice, or legal advice. All investment decisions are made solely by the User. Digital assets are volatile and speculative, and the User acknowledges the risk of partial or total loss of invested capital.

Bitjust does not guarantee any returns on digital asset holdings. Past performance is not indicative of future results. The User is solely responsible for assessing whether any Service is appropriate for their financial situation, risk tolerance, and investment objectives.

5. Intellectual Property Rights

The User is granted a limited, non-transferable license, subject to these Terms, to use the Platform and related content, materials and information (collectively, "the Content") solely for approved purposes as permitted by Bitjust from time to time. Any other use of the Platform, Services or Content is expressly prohibited.

The name "Bitjust" and all logos, trade names, marks, or designs related to the Services or displayed on the Platform are either trademarks or registered marks of Bitjust LTD or its affiliates. The User shall not copy, imitate or use such logos or marks without prior written consent.

6. Personal Data Protection

Bitjust shall request and obtain information and documentation from the User in order to comply with applicable Anti-Money Laundering laws and regulations. Such information may include identification documents and any other information which could be considered personal data.

Any personal data provided to Bitjust is retained according to the Bitjust Privacy Policy. Once the business relationship has been terminated, the User may request to have their data erased or deleted, subject to applicable legal retention requirements.

The User understands that by entering into this Agreement, they explicitly consent to the collection and processing of their personal data. The User retains the right to withdraw consent, access, correct, update, rectify, erase, restrict, or port their data, and to lodge a complaint with the relevant supervisory authority.

If the User chooses not to provide required personal data, Bitjust reserves the right to terminate the business relationship or refuse to enter into this Agreement.

7. Fees

Fees applicable to the Services are set out on the Website and within your Bitjust Account. Fees are subject to change at our sole discretion. Updated fees will be posted on the Website. By continuing to use the Services after any fee changes, You accept the modified fees. If You do not agree, You must immediately stop using the Services.

8. No Warranties

The Website and Services are provided "as is," with all faults, and Bitjust makes no express or implied representations or warranties of any kind related to the Website, the Services, or the materials contained on the Website. Nothing contained on the Website shall be construed as providing financial, investment, tax, or legal advice.

9. Limitation of Liability

You agree to indemnify and hold harmless the Company and its affiliates, subsidiaries, employees, managers, officers, directors, partners, and shareholders from any losses, damages, suits and expenses, including reasonable legal fees, that we incur in connection with or arising out of your access to or use of the Services, your breach of these Terms, or violation of any law.

We are not liable for claims, costs, losses or damages caused by events beyond our reasonable control, including acts or omissions of third parties, natural disaster, emergency conditions, government action, equipment or communications malfunction, or digital asset network failures.

We are not liable for special, incidental, exemplary, punitive or consequential losses or damages of any kind.

10. Risk Disclosure

The User acknowledges and accepts the following risks inherent to digital asset services: digital asset prices are highly volatile and may decline significantly in value; digital asset markets operate continuously and are subject to rapid changes; digital assets may be subject to regulatory changes that could impact their value or legality; digital asset transactions are generally irreversible; digital asset networks may experience disruptions, forks, or security breaches; and there is no guarantee that any digital asset will maintain its value.

11. Applicable Law and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of the Republic of the Marshall Islands. In the event of a dispute, the User submits to the non-exclusive jurisdiction of the courts of the Republic of the Marshall Islands.

12. Severability

If any provision of these Terms is found to be illegal, void, or unenforceable under applicable law, the applicable law overrides that provision to the extent of the inconsistency, and the remaining provisions shall continue in full force and effect.

13. Third-Party Services

The Platform may contain links to websites or services controlled by third parties. Bitjust disclaims liability for any information, materials, products or services offered at third-party websites. Bitjust does not endorse any products, services, or information contained at those websites.

14. Assignment

Bitjust shall be permitted to assign, transfer, and subcontract its rights or obligations under these Terms without notice or consent of the User. The User shall not assign, transfer, or subcontract any rights or obligations under these Terms.

15. Communication

These Terms are written in English and are subject to change only in English. In the event of any discrepancy in translation, the English version shall prevail. All communications from Bitjust to the User will be made via the email address registered with the User's Bitjust Account or through the Website.
